Terms of Use
1. Acceptance of Terms
By downloading, installing, or using SlopeLab ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 16, you may not use the App under any circumstances.
3. Description of the App
SlopeLab is a ski and snowboard session tracker that uses your device's GPS to record your runs, lifts, and rest periods on the mountain. The App classifies your movement, computes session statistics (distance, speed, vertical drop, duration), and stores all data locally on your device.
4. Subscription and Payments
4.1 Free and Premium Features
Note: The current release is a free beta. In-app subscriptions are not active in this version. Sections 4.2–4.4 below apply when subscriptions are enabled in a future release.
The App may offer certain features behind a paid subscription. Details about subscription tiers, pricing, and included features are presented within the App and on the Apple App Store.
4.2 Billing
All subscriptions are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms. Aliaksei Khitro does not directly process or store your payment information.
4.3 Auto-Renewal and Cancellation
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription through your Apple ID account settings. No refunds are provided for partial billing periods, except as required by applicable law.
4.4 Price Changes
Subscription prices may change from time to time. You will be notified of any price changes in advance and will have the opportunity to cancel before the new price takes effect.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, decompile, or disassemble the App.
- Use the App in a manner that could damage, disable, overburden, or impair its functionality.
- Attempt to gain unauthorized access to any systems or networks connected to the App.
- Redistribute, sublicense, or resell the App or any part thereof.
6. Intellectual Property
All content, features, and functionality of the App — including but not limited to design, code, graphics, and trademarks — are owned by Aliaksei Khitro and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
7. Location Data and Safety
7.1 GPS Accuracy
The App relies on your device's GPS hardware. GPS accuracy can be affected by weather, terrain, satellite availability, and device settings. The App does not guarantee the accuracy of any location, speed, distance, or altitude data.
7.2 Safety Disclaimer
The App is not a safety device. You should never rely on the App for navigation, avalanche awareness, trail selection, or any decision that affects your physical safety. Always follow posted signs, ski patrol guidance, and resort rules. Skiing and snowboarding are inherently dangerous activities — use the App at your own risk.
7.3 Distracted Use
Do not operate the App while actively skiing, snowboarding, or otherwise moving on the mountain in a way that diverts your attention from your surroundings.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALIAKSEI KHITRO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALIAKSEI KHITRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ALIAKSEI KHITRO'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY UNITED STATES DOLLARS (USD $50).
10. Indemnification
You agree to indemnify, defend, and hold harmless Aliaksei Khitro from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or your violation of these Terms.
11. Termination
Aliaksei Khitro reserves the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App is immediately revoked.
12. Changes to These Terms
These Terms may be updated from time to time. The updated version will be indicated by the "Last Updated" date at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
13.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California. You agree to waive any right to a jury trial or to participate in a class action.
13.3 European Union Users
If you are a consumer residing in the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection legislation. You may bring proceedings in the courts of your country of residence.
14. Third-Party Services and Content
The App uses map data from OpenSnowMap (an open-source project built on OpenStreetMap data) to display resort trail overlays. OpenStreetMap data is available under the Open Data Commons Open Database License (ODbL). Your use of OpenSnowMap map tiles is subject to OpenSnowMap's own terms of use.
The App uses Amplitude for anonymous product analytics. Your use of the App constitutes acceptance of Amplitude's terms of service and privacy policy (https://amplitude.com/privacy).
15. Apple App Store Terms
You acknowledge that these Terms are between you and Aliaksei Khitro only, not with Apple Inc. ("Apple"). Aliaksei Khitro, not Apple, is solely responsible for the App and its content. Your use of the App must comply with the Apple App Store Terms of Service.
Apple has no obligation to provide maintenance or support services for the App. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation.
In the event of any third-party intellectual property claim relating to the App, Aliaksei Khitro, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of such claim.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited or restricted parties list.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and Aliaksei Khitro regarding the use of the App and supersede all prior agreements and understandings.
